These Terms of Service (“Terms”) are an agreement between you and Honey House LLC, doing business as Honey House (“we”, “us”), and govern your use of honeyhousehoney.com, our related pages and social channels, and every purchase you make from us (the “Services”). By using the Services or placing an order you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 18, or the age of majority where you live, to place an order. If you create an account you are responsible for keeping your login confidential and for all activity under it. Tell us promptly if you suspect unauthorised use.

2. Products

We sell raw honey, honey products, candles, gift packs and branded apparel. Our honey is a natural agricultural product: color, flavor, texture and crystallisation vary by harvest and season, and product photos are representative rather than exact. Raw honey should not be given to infants under 12 months. Product descriptions, nutrition information and allergen statements are provided in good faith from our suppliers; if you have a specific allergy or medical concern, contact us before ordering.

3. Ordering, pricing and availability

All prices are in U.S. dollars and exclude shipping and taxes, which are shown at checkout. Prices, promotions and availability can change without notice, and we may limit quantities. Your order is an offer to buy; we accept it when we send a shipping confirmation. We may cancel or refuse an order at any time before shipment — for example if a product is out of stock, a price or description contained an error, we suspect fraud, or the order violates these Terms — and will refund any amount charged. If a product is listed at an incorrect price, we will contact you before charging the corrected price or cancelling.

4. Payment

You authorise us and our payment processors to charge your chosen payment method for the total shown at checkout, including any subscription renewals. You represent that you are authorised to use that method. If a payment fails we may retry it or cancel the order.

5. Discounts and promotions

Discount codes and automatic discounts apply only to eligible products, only during their stated period, and only under the conditions shown with the offer. Unless an offer says otherwise, one code can be used per order and automatic quantity discounts are calculated on eligible items in the cart at the time of purchase. We may correct, limit or withdraw a promotion applied in error or used in a way that is fraudulent or abusive.

6. Subscriptions

If you buy a subscription, you authorise recurring charges to your saved payment method at the frequency and price shown when you subscribe, until you cancel. We will email you before each renewal where required by law. You can skip, pause or cancel at any time in your account or by emailing us; changes apply to renewals that have not yet processed. We may change the price of a subscription with at least 30 days' notice by email, and you may cancel before the change takes effect. Subscription shipments follow the Shipping Policy and Return and Refund Policy.

7. Shipping, returns and refunds

Delivery is governed by our Shipping Policy, and returns, exchanges and refunds by our Return and Refund Policy, both of which are part of these Terms. In short: we ship within the United States, orders of $75 or more ship free, food products cannot be returned but are replaced or refunded if they arrive damaged or incorrect, and apparel can be exchanged for size within 14 days if unworn with tags.

8. Intellectual property

The Services and everything on them — text, photographs, graphics, logos, the Honey House name and marks, artwork on our products and packaging, designs and software — are owned by Honey House LLC or our licensors and protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. Any other use, including reproduction, resale, scraping or use in training data sets, requires our written permission. Collaboration artwork on apparel remains the property of the artist and Honey House as stated on the product page.

9. Reviews and content you submit

If you post a review, photo, comment or other content on our site or tag us on social media, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce, edit and display it in connection with our business, including on our website, emails and ads, with credit where practical. You confirm you own the content, it is truthful, and it does not infringe anyone else's rights or contain unlawful, offensive or private material. We may remove content at our discretion. Reviews collected through our review provider are subject to that provider's terms as well.

10. Acceptable use

You agree not to use the Services for any unlawful purpose; to place fraudulent or automated orders; to interfere with the security or operation of the site; to scrape, copy or harvest data or content; to impersonate anyone; or to resell our products commercially without a wholesale agreement. We may suspend or terminate access for violations.

11. Third-party services and links

The Services use third-party providers such as Shopify, payment processors, shipping carriers and review, email and SMS platforms, and may link to sites we do not control. Those services have their own terms and policies, and we are not responsible for them.

12. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Services will be uninterrupted or error-free. Nothing in these Terms limits warranties or rights that cannot be limited under applicable consumer law, and nothing limits our liability for fraud or for death or personal injury caused by our negligence.

13. Limitation of liability

To the fullest extent permitted by law, Honey House LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from the Services or these Terms. Our total liability for any claim relating to an order is limited to the amount you paid us for that order in the 12 months before the claim arose.

14. Indemnification

You agree to defend and hold Honey House LLC harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your content, or your misuse of the Services.

15. Governing law

These Terms and any dispute arising from them or from your use of the Services are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law rules. If you are a consumer, you also keep any protections of the mandatory law of the state where you live.

16. Disputes

If you have a problem, please contact us first at info@honeyhousehoney.com; most issues are solved in a reply or two. If we cannot resolve a dispute informally within 30 days after either of us gives written notice, either party may bring the claim in the state or federal courts located in Denver County, Colorado, and both parties consent to the personal jurisdiction and venue of those courts. Either party may instead bring an eligible claim in small claims court. To the extent permitted by law, each party waives the right to a jury trial and agrees that claims will be brought individually and not as a plaintiff or class member in any class or representative proceeding.

17. Electronic communications

By using the Services you consent to receive notices, agreements and other communications from us electronically, and agree that electronic records and signatures satisfy any legal requirement for writing or signature.

18. Changes to these Terms

We may update these Terms at any time by posting the revised version with a new “Last updated” date. Changes apply to orders placed after they are posted; the Terms in force when you ordered govern that order. Continued use of the Services after a change means you accept it.

19. General

These Terms, together with the Privacy Policy, Shipping Policy and Return and Refund Policy, are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Headings are for convenience only.
